Re: Baker Residential motion for reconsideration


Dear Mr. Ours:

Even if Baker Residential could resolve right of way issues with Washinton Garden Apartment and even if Norfolk Southern allowed a grade crossing of the railroad tracks, there remains an impossible obstacle: The entire area, across the tracts, where Baker would construct a road, is wetlands. I believe, testimony, at the planning board hearings established this fact for the record. Consequently, in addition, to agreement from Washinton Garden Apartment and Norfolk Southern for access, add the New Jersey Department of Environmental Protection undoing existing wetlands regulations which is very unlikely. The Baker property is a swamp on three sides with a mountain in the rear. Additionally, the adjacent property, to the south, where access would be gained from Millpond Road is wetlands and habitat for the federally endangered bog turtle.
